2025 APOS Waterfowl Allocation Auction Terms and Conditions
By bidding at the 2025 Waterfowl Allocation Auction, the prospective bidder agrees to the Terms and Conditions found herein.
DEFINED TERMS:
“APOS” means the Alberta Professional Outfitters Society, which is continued as a delegated authority under Schedule 3 of the Wildlife Regulation, AR 143/97, as amended from time to time.
“Auction” means an allocation auction held by APOS, online or in-person.
“Lot” means any individual or group of allocations placed for sale in the Auction and, specifically, as described by each Lot number in the Auction catalogue.
“Reserve” means the minimum bid price APOS will accept for the sale of a specific numbered Lot.
“Sale Price” means the final ending bid price that APOS accepts for the sale of the Lot at the Auction.
“Buyer” means the person who makes the highest bid on the Lot at the Auction held by APOS and meets these Terms and Conditions.
“Sales Tax” means the applicable sales tax in Alberta at the time of sale.
“Purchase Price” means the Sale Price and Sales Tax of the Lot, if applicable.
“Registered Bidder” means the holder of (or person authorized to represent the holder of) a current Outfitter Permit holder who has fully completed the auction registration by the deadline.
THE AUCTION PROCESS:
1. APOS
a. is facilitating the sale of the Lots, pursuant to its authority under the Wildlife Act, its regulations, and the 2022 Memorandum of Understanding with the Government of Alberta;
b. is not liable or responsible for any delays in online registration for the Auction of prospective Registered Bidders;
c. shall not be held liable for any errors or omissions in the Auction catalogue or any other supplementary material produced by APOS in reference to a specific Lot put for sale at the Auction;
d. shall not be held liable or in any other way responsible for the value or condition of the Lots;
e. APOS, its employees, officers, agents, representatives and Board, shall not be responsible for the correctness of any statement as to the attribution of any Lot or for any other errors of description or for any faults or defects in any Lot and no warranty whatsoever is given by APOS, its employees or Board in respect of any Lot and any express or implied conditions or warranties are hereby excluded;
f. shall have the absolute discretion to refuse any bid, withdraw any Lot or, in the case of default of payment, put up any Lot for auction or sale again;
g. may sell unsold Lots through other means following the auction; and
h. shall have absolute discretion in settling any dispute with respect to the highest Registered Bidder and the final Sale Price.
2.Lot Descriptions
a. All representations or statements made by APOS at the Auction, in the Auction catalogue, or any supplementary material produced by APOS are solely for guidance and are not necessarily a true representation of the Lot.
3. Registered Bidders
a. To bid on a Lot, every Registered Bidder must be a current Outfitter Permit or be authorized in writing to represent a current Outfitter Permit holder.
b. If the Registered Bidder is a Big Game Outfitter Permit holder and successfully purchases a Waterfowl Allocation, they will be required to upgrade to a Big Game/Bird Game Outfitter Combo Permit before the Lots will be transferred.
a. The requirement to obtain a Bird Game Guide Designation under a currently permitted Bird Game Outfitter is waived for those already holding a current Big Game Outfitter Permit and Guide Designation.
c. Must either:
i. Fully complete the Auction registration process by 11:59 PM on Sunday, August 10, 2025. This includes creating an account and signing up for the “APOS 2025 Waterfowl Allocation Auction” and agreeing to these Terms and Conditions;
d. Acknowledge that once a bid, either in-person or online, is made with their Registered Bidder bid number, it may not be withdrawn without the consent of APOS, who, in their sole discretion, may refuse such consent;
e. Must satisfy themself as to the value and condition of a Lot by their own investigation or otherwise prior to bidding on a Lot.
4. The Buyer
a. Is the highest Registered Bidder acknowledged at the time the bidding on a Lot ends.
b. May opt to purchase all remaining items within the Lot at the Sale Price, or a portion of them;
c. Acknowledges that the minimum bid for any waterfowl allocation is $1,000.
d. Acknowledge and agrees that if a Lot is sold on their bid, they are bound to purchase the Lot for the Purchase Price, with their highest bid acting as the Sale Price.
e. all Lots are subject to Allocation Renewal Fees and Waterfowl Selection Fees, totaling $500 per allocation, as well as a $10 transfer fee per allocation upon purchase,
f. Acknowledges and agrees that invoices generated during or shortly after the auction may not be error free and are therefore subject to review and amendment by APOS.
g. Understands that APOS will not be ready to collect payment and transfer the purchased allocations to the Buyer until the week of August 25, 2025.
h. Shall pay the Purchase Price within 30 days of receiving notification that APOS is ready to accept payment. Regular policies regarding late payments and non-sufficient fund cheques will apply.
i.assumes all risk of purchase of a Lot and may not under any circumstances seek to return a purchased Lot to APOS.
5. Purchased Lots
a. If the Buyer fails to pay for any Lot within 30 days receiving of notification that APOS is ready to accept payment, APOS may, without providing further notice to the Buyer and without prejudice to any other rights or remedies:
i. Rescind the sale of that or any other Lot(s) sold to the Buyer.
ii. Resell the Lot or cause it to be resold by online sale at any price above the Reserve; and/or
iii. In the absolute discretion of APOS, to refuse or revoke the Buyer’s registration in any future auctions held by APOS.
GENERAL CONDITIONS
A. Access to the online bidding services is made available as a convenience. APOS reserves the right to suspend or terminate any aspect or feature of the online bidding service (including the online bidding service in its entirety) at any time, with or without notice. Without limiting the foregoing, APOS may suspend access to online bidding to carry out scheduled or unscheduled maintenance or for any other reason at any time.
B. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein and all parties concerned hereby submit to the exclusive jurisdiction of the Alberta Courts with any issues to be resolved in Edmonton.
C. Unless otherwise provided for herein, all monetary amounts referred to herein shall refer to the lawful money of Canada.
D. All words importing the singular number shall include the plural and vice versa, and words importing the use of any gender shall include the masculine, feminine and neuter genders and the word “person” shall include an individual, a trust, a partnership, a body corporate, an association or other incorporated or unincorporated organization or entity.
E. If any provision of the Terms and Conditions or the application thereof to any circumstances shall be held to be invalid or unenforceable, the remaining provisions of these Terms and Conditions, or the application thereof to other circumstances, shall not be affected thereby and shall be held valid to the full extent permitted by law.
